Marketplace Terms, Disclaimers, and Platform Rules
1. Platform Overview
Kwick is a digital marketplace that connects buyers with independent merchants and individuals offering products for sale.
Kwick does not own, stock, or directly sell the products listed on the platform unless explicitly stated. All listings are created and managed by independent sellers.
Kwick provides:
- A discovery platform for buyers
- A listing platform for merchants
- Basic moderation and merchant vetting
Transactions and product exchanges occur between buyers and sellers.
2. Merchant Responsibility
All merchants on Kwick are responsible for:
- The accuracy of their listings
- Product quality and condition
- Pricing and availability
- Delivery arrangements
- Payment agreements with buyers
- Customer communication
Kwick may verify merchants during onboarding but cannot guarantee the conduct or performance of every seller on the platform.
Merchants agree that any disputes, complaints, or legal claims relating to products sold are their responsibility.
3. Buyer Responsibility
Buyers using Kwick acknowledge that:
- Products are listed by independent merchants.
- Kwick does not guarantee product condition or seller performance.
- Buyers should review listings carefully before purchasing.
Buyers are encouraged to:
- Verify seller details
- Ask questions before purchasing
- Use safe payment and collection practices
- Meet in safe locations where applicable
4. Merchant Verification Disclaimer
Kwick performs reasonable efforts to vet merchants during onboarding. However:
- Verification is not a guarantee of merchant credibility.
- Identity documents and business information may change over time.
- Some sellers may misrepresent products or intentions.
Kwick cannot be held liable for fraudulent behavior conducted by independent users.
5. Payments and Transactions
Kwick does not directly process or control payments between buyers and sellers unless otherwise specified.
Payment arrangements may include:
- Direct payment
- Bank transfer
- Cash on collection
- Third-party payment systems
All financial agreements occur between buyer and seller.
Kwick is not responsible for:
- Payment disputes
- Non-delivery
- Product dissatisfaction
- Refund disagreements
6. Delivery and Collection
Delivery and logistics are arranged directly between buyers and sellers. This may include:
- In-person collection
- Local delivery
- Courier services arranged by the seller
Kwick does not manage or guarantee delivery timelines or shipping conditions.
7. Product Authenticity Disclaimer
Kwick encourages merchants to list authentic products. However, Kwick cannot guarantee:
- Authenticity
- Originality
- Brand ownership rights
- Product legality
If a buyer suspects counterfeit or prohibited items, they should report the listing to Kwick immediately.
8. Prohibited Listings
The following items may not be listed on Kwick:
- Illegal products
- Stolen goods
- Counterfeit branded items
- Weapons or controlled items
- Harmful or dangerous products
- Fraudulent or misleading listings
Kwick reserves the right to remove listings, suspend accounts, or ban merchants without prior notice.
9. Platform Moderation
Kwick may review listings, accounts, and communications to maintain platform safety. However, due to the scale of marketplace activity, Kwick cannot review every listing in real time.
Users are encouraged to report suspicious listings.
10. Limitation of Liability
Kwick operates solely as a digital marketplace platform. Kwick shall not be liable for:
- Losses arising from transactions between users
- Fraud committed by sellers or buyers
- Product defects
- Personal injury related to purchased products
- Delivery failures
- Payment disputes
By using the platform, users acknowledge that transactions occur at their own discretion and risk.
11. User Conduct
All users must agree to:
- Provide accurate information
- Treat other users respectfully
- Avoid fraudulent or misleading behavior
- Follow applicable laws
Users violating platform rules may have their accounts restricted or permanently banned.
12. Dispute Handling
Kwick may assist in facilitating communication between buyers and sellers. However, Kwick is not obligated to resolve disputes or provide compensation.
Disputes remain the responsibility of the parties involved.
13. Account Suspension
Kwick reserves the right to suspend or terminate accounts that:
- Violate platform policies
- Engage in fraudulent activity
- Harm other users or the platform
14. Changes to Terms
Kwick may update these policies periodically. Continued use of the platform after updates constitutes acceptance of the revised terms.
