Seller Agreement

1. Introduction

This Seller Agreement governs the relationship between Kwick and individuals or businesses that list products for sale on the Kwick marketplace.

By creating a merchant account or listing products on Kwick, you agree to comply with this Seller Agreement.

2. Role of the Platform

Kwick operates as a technology platform connecting buyers and sellers. Kwick does not:

  • Own merchant inventory
  • Manage merchant logistics
  • Handle merchant product storage
  • Participate directly in sales transactions

Merchants operate independently and remain responsible for their business activities on the platform.

3. Merchant Eligibility

To sell on Kwick, merchants must:

  • Be at least 18 years old
  • Provide accurate identity or business information
  • Comply with applicable laws and regulations

Kwick may request verification documents including:

  • Government-issued identification
  • Business registration documents
  • Contact details

Failure to provide accurate information may result in account suspension.

4. Merchant Responsibilities

Merchants agree to:

  • List products truthfully and accurately
  • Disclose product condition and defects
  • Use genuine product images
  • Honour agreed pricing
  • Communicate with buyers respectfully
  • Fulfil delivery or collection arrangements

Merchants are solely responsible for:

  • Product authenticity
  • Delivery arrangements
  • Customer service
  • Returns or refunds where applicable

5. Product Listings

Merchants must ensure listings include:

  • Accurate product descriptions
  • Clear pricing
  • Honest condition details
  • Real images where possible

Kwick may remove listings that are misleading, fraudulent, or in violation of marketplace policies.

6. Merchant Conduct

Merchants may not:

  • Post fraudulent listings
  • Sell counterfeit products
  • List stolen goods
  • Mislead buyers about product quality
  • Manipulate platform rankings or listings

Violations may result in listing removal, account suspension, or permanent banning from the platform.

7. Payments and Transactions

All transactions conducted through Kwick occur directly between buyers and sellers. Kwick does not guarantee payment completion, delivery outcomes, or buyer behaviour.

Merchants assume full responsibility for payment arrangements.

8. Merchant Liability

Merchants are responsible for any claims arising from:

  • Product defects
  • Misrepresentation
  • Intellectual property violations
  • Consumer protection complaints

Kwick is not liable for merchant product disputes.

9. Account Suspension

Kwick reserves the right to suspend or terminate seller accounts that:

  • Violate marketplace policies
  • Engage in fraudulent behaviour
  • Harm users or the integrity of the platform

10. Updates to the Agreement

Kwick may update this Seller Agreement periodically. Continued use of the platform indicates acceptance of updated terms.
